Summary

The article analyzes the scientific literature and norms of the current legislation concerning the concept definition and features of the administrative and legal provision of personnel training for the penitentiary system of Ukraine. The author focuses on the study of the concept of administrative and legal provision. The views of scientists concerning the definition of the very concept of administrative and legal provision and depending on the sphere of its application are analyzed. Highlights of its main features, which are inherent in both general and special aspects according to the sphere of application.

In order to in-depth understanding of the essence of administrative and legal provision, its structure (elements), fixed assets, forms and methods of realization are defined. The main elements are the subject, object, content of administrative and legal relations, legal norms, means, forms and methods of their implementation.

On the basis of the analysis, the administrative and legal provision of training for the penitentiary system of Ukraine, as a set of normative legal norms aimed at regulating legal relations in the specified sphere, is determined. The relevant mechanisms, means, forms and methods of their implementation are also determined, with certain responsibilities and authorizing bodies of state power for implementation of state policy in the field of execution of sentences. Particular attention is paid to the concept of “organization of legal provision” and “administrative procedure in the State Criminal-Executive service of Ukraine”. Personnel training for the penitentiary system of Ukraine is an important factor in its further functioning, therefore the organization of administrative and legal provision should be proper.

The effectiveness of this process reflects the timely adoption of normative acts, along with the society development, as well as the quality of certain legal norms contributes to the productive activity of the mechanisms for the training process implementing of the penitentiary system of Ukraine. The author attributes the administrative procedure to the mechanism of the specified process settlement and the means of its realization in practice.
