Prostitution and artificial intelligence (criminal-legal influence on some socialdangerous encroachment)

Summary

The report deals with issues of information security, weakening of the preconditions of prostitution and related criminal activities (creation or maintenance of places of debauchery and pimping, pimping, involvement in prostitution, trafficking in human beings, exploitation of children, corruption of minors, etc.) due to immersion of broad masses of customers in the virtual worlds of artificial intelligence, the recognition of the artificial intelligence as subject of criminal law relations.

The following conclusions and suggestions were grounded: 1) the virtual worlds will become more exciting than the ordinary human life; 2) the provision of widespread access to virtual worlds, including in the field of sexual services and pleasure, will be considered as a kind of social valve in the nearest future, which will reduce dissatisfaction with the growing gap between the rich and the poor; 3) the world of virtual sexual relations creates a powerful competition with the usual forms of prostitution and related forms of misconduct (in particular, the creation or maintenance of places of infertility and intercourse between individuals, the pimping or the involvement of individuals in prostitution, etc.); 4) ordinary prostitution (regardless of whether it will be legalized) will not disappear completely but will eliminate its underlying reason and considerable demand from consumers; 5) the virtual world will be cared for artificial intelligence; 6) artificial intelligence may be known by the subject of legal relationship, endowed with the legal status of «electronic person (electronic person)»; 7) the prospect of application of criminal-law measures to artificial intelligence is quite realistic; the appearance in this regard of the section under the conditional name XIV-2 «Measures of criminal-law nature concerning electronic entities» in the Special Part of the Criminal Code of Ukraine; 8) A person must learn to maintain control over the intellectual intelligence.
