PRINCIPLE OF SILENT CONSENT AND DECLARATIVE PRINCIPLE IN THE FIELD OF ADMINISTRATIVE SERVICES PROVIDING

Summary

The article is devoted to the legal issues of providing administrative services in Ukraine. It is established that entrepreneurs have the right to start their economic activities using the principle of silent consent and declarative principle. It is concluded that the principle of silent consent can be realized only in case of two conditions, in particular: 1) the required documents are submitted in accordance with the list of legislation established (this statement, as well as documents, which testify to the compliance of the material and technical base of the company with the requirements in force in the legislation; 2) the permit document or the decision to refuse the permit was not issued or not sent to the initiator of obtaining the permit (the legislator has set a 10-day period for the permit authority to send the reply). In the absence of an appropriate response from the permit authority within the above-mentioned period, it may be assumed that the document has been issued. A declarative principle means that an entrepreneur has the right to carry out his activity without obtaining a permit document by informing the state administrator or the appropriate permit authority that his material and technical basis is in conformity with the requirements of the applicable law.The article analyzes the Draft Law on Amendments to the Law of Ukraine “On Administrative Services” regarding the improvement of the procedure of administrative services providing. Theoretical and legal analysis of the problems of applying declarative principle in administrative services providing in Ukraine has been carried out, as well as ways of their solution have been proposed.
