SOCIAL ADAPTATION OF PERSONS RELEASED FROM THE PENITENTIARY INSTITUTIONS IN THE CONDITIONS OF THE PENETRAL SYSTEM REFORM

Summary

In conditions of society`s development, the reform of its social institutions, in those whose purpose is the fight against crime, the issue of eliminating recidivism is acutely raised. More and more tangible is the need to develop a general theory of social adaptation. It is a comprehensive study of the social adaptation process of persons released from places of imprisonment, the mechanism of their interaction with social environment, the new forms of the recidivism combating of antisocial behavior of these individuals, the characteristics of the social adaptation process of certain categories of persons and the development of these data methods and measures to prevent such manifestations and consolidate them in a normative way.

Social rehabilitation of former convicts should be based on the humanization of the attitude of society towards them. Society must reach the stage of development, when at the moral and legislative levels there will be unity in understanding that punishment for a committed offense is not a penalty and a term for life, but serves only as an instrument of the state, one of the main tasks of which is eradication of crime. In conditions of harmonization of the Ukrainian legislation with the right of the European community states, where the idea of a person as the highest value is the dominant, where the duty of the state is to prepare a person, who served a long time sentence in isolation from society, into a life in society becomes the most important issue. Therefore, the evolution and constant development of the legal mechanism for the process regulation of reintegration of former convicts into the society, the concrete normative definition of the duties and powers of the state and other public institutions in the implementation of social adaptation of the released persons, significantly increases the effectiveness of this process and has a positive impact on crime reduction in society.
